Terms & Conditions
The purchase of any travel services offered by Food N wine Vacations, Inc, ('Food N' Wine Vacations') and by participating in any tour, event of Food N' Wine Vacations Inc, constitutes a contractual agreement between you and Food N' Wine Vacations, Inc, and represents your acceptance of Food N wine Vacations, Inc terms and conditions set out herein. Please ensure that you read carefully these terms & conditions prior to booking.
The lead traveler assumes the responsibility of sharing This Agreement with each traveler for whom they are booking behalf. In the case the booking is made by a Travel Advisor, the Advisor is responsible to provide all travelers with a copy of This Agreement. Food N' Wine Vacations is not responsible for any tour participant unawareness of the Terms and Conditions or any other provisions in This Agreement due to the failure of the lead traveler or Travel Advisor to share this information with all other travelers.
TOUR PRICE
Prices are is USD.
Prices are person based on double occupancy. Single room supplement apply when applicable.
TRANSFERS
Where transfers are included, there is one scheduled group transfer for arrival and departure at a designated time and place. It is the responsibility of the tour participant to be at the transfer point and time.
DEPOSIT & FINAL PAYMENT
A deposit is required to reserve a space in any program. Reservation is not confirmed until receipt of deposit by Food N Wine Vacations, Inc, and a receipt of a signed credit card authorization form and/or any waivers required by Food N' Wine Vacations.
The amount of the deposit is $500.00 per person unless noted otherwise.
The second deposit of $500.00 is due 180 days prior the first day of the tour.
The balance is due 90 days prior the first day of the tour.
Private groups may be required to pay a higher deposit amount.
PRICING
Food N wine vacations, Inc reserve the right to re-calculate prices due to fluctuations in the market and exchange rates.
BALANCE
90 days or less before the start date of the tour, the tour is non – refundable.
Final payment is non refundable.
REFUNDS AND ADJUSTMENTS
Deposit refund is possible for the first 30 days from the date of deposit so long as you have booked more than 180 days before the start date of the tour. If you book within 180 days of the start date of the tour, your deposit is immediately non-refundable.
There will be no refunds or adjustments for unused portion of the tour. In case of a problem you must notify your local host or make Food N wine Vacations aware while you are in the program.
TRAVEL INSURANCE
We highly advise you to protect your investment, protect yourself from the unexpected and purchase travel insurance
The travel insurance should cover medical coverage for illness or personal injury, trip cancellation, interruption and delay.
You acknowledge that insurance coverage is not included in the cost of any Tour offered by Food N' Wine Vacations Inc. and you are required to obtain separate coverage at your own expense. It is your responsibility to ensure that you have sufficient coverage and comply with the terms of the applicable insurance plans.
ITINERARY CHANGES & FLEXIBILITY
The itinerary subject to minor changes before the tour begins. Changes may be reorganization of days due to closure and festivals, changes due to weather, or seasonal changes. The itineraries are prepared well in advance, and at times there are unexpected closures for various reasons that require Food N’ Wine vacations, Inc to alter the plans.
TRAVEL DOCUMENTS
It is the tour participant responsibility to obtain a valid passport and to pay for all visas and entry documents, for meeting all health and other requirement and for any document required by laws, regulations, orders and/or requirements of the countries he/she will visit. Non-us Citizens are responsible for obtaining all visas and entry documents independently.
Failure to have a valid passport, or other required documents, will likely result in you not being able to leave a country or enter a destination. No refund will be available and Food N' Wine Vacations will accept no liability in such a case.
FORCE MAJEURE
Food N' Wine Vacations Inc will not be liable for any loss, damage, delay, bodily injury (including emotional distress or injury), illness, death, damage or other loss or detriment to person or property or financial costs both direct and indirect incurred, caused by or cancellation resulting in whole or in part caused by Act of God or any other Force Majeure condition, such as, and without limitation: fire, volcanic eruption, extreme weather, contamination, earthquake, flood, water or power shortages or failures, tropical storms or hurricanes, mechanical breakdowns, riots or civil commotion, political disturbance , sabotage, arrests, strikes or labor disruptions, government restraint, government seizures, government health advisories, acts of terrorism, war, insurrection, quarantine restrictions, epidemics, pandemics, warnings or alerts of any kind, or any other unforeseen circumstances or any other factors unforeseen by Food N' Wine Vacations or the Third party suppliers that impacts negatively on its ability to fulfill any of its contractual agreement. In the event that any conditions of Force majeure apply, Food N' Wine Vacations Inc shall be excused, discharged, and released from performance without liability of any kind including liability to make any refund.
LIABILITY DISCLAIMER
Food N wine Vacations, Inc and its representatives, act only as an intermediary for the suppliers, services associated with the tour. Food N wine Vacations, Inc does not own or operate any of the vehicles, suppliers, accommodations and services connected to the tour, therefore, the tour participant agrees that neither Food N wine Vacations, Inc nor its affiliates and/or representatives shall be liable for any direct or indirect, punitive, incidental or consequential damage, accident, loss (including personal injury, death and property loss) or expense occasioned by any act or omission of any supplier providing services.
Food N Wine Vacations, Inc and its representatives accept no responsibility for any damage, delay, or irregularity, expense or liability arising from sickness, theft, labor disputes, machinery breakdown quarantine, government restraints, war, weather conditions, nor for any additional expenses or damage due to the changes in schedules or services, or any other cause beyond their control.
Food N Wine Vacations, Inc reserves the right to cancel, change or reschedule tours for any reason.
HEALTH
The tour/program participant certifies that he/she does not have any condition that will create a hazard for other participants on the subject tour/program. Food N’ Wine Vacations, Inc reserves the right to decline, accept or retain a tour/program participant, whose health or actions impede the operation of the trip or the welfare and enjoyment of the other tour/program participants in the subject tour.
DIETARY REQUESTS
All food allergies and dietary restrictions must be disclosed at the time of booking your tour. We will do our best to accommodate dietary requests, However, we cannot guarantee it.
PHOTOGRAPHY RELEASE
The tour participants permits Food N Wine Vacations, Inc to photographs, films, images, text, testimonials of participants for its own commercial use without compensation to participants.
AMENDMENTS
Food N' Wine Vacations reserves the right to update or alter these Terms and conditions at any time.
All the changes to these Terms and Conditions become immediately effective upon being posted by Food N' Wine Vacations at https://www.foodnwinevacations.com/terms-and-conditions
We recommend that you go over the Terms and Conditions prior to your tour for the most up-to-date version available.
APPLICABLE LAW AND JURISDICTION
The Contract and these Terms are subject to the laws of the State of Georgia in the United States of America.
You agree and acknowledge to the exclusive jurisdiction of the courts of Georgia, USA for the resolution of any dispute under these Terms or concerning any Tour, product or service.
